1. Preamble
The purpose of these General Terms and Conditions of Sale (hereinafter referred to as "GTCS") is to define the contractual terms and conditions applicable to services provided by Polarized, a SASU with capital of 10,500 euros, registered with the Antibes Trade and Companies Registry under number 893 968 909, headquartered in Biot (France), acting under the trade name atable.io. These services are exclusively reserved for professionals acting within the scope of their activity.
2. Object
The purpose of these GTC is to define the conditions under which Polarized provides the customer with services for the creation, hosting, maintenance and updates of a website, in accordance with the contractual stipulations and according to the package chosen by the customer.
3. Description of services
The service includes :
- The creation of a website comprising a main page and an "Interactive Map" page, customized from a template belonging to atable.io (choice of color palettes, typography, integration of customer-supplied content).
- Integration of redirections to the customer's own reservation tools (such as Zenchef, Lafourchette, etc.).
- Integration of a Google Maps module.
- Hosting of the website on Amazon Web Services (AWS) servers, located in the AWS Datacenter in Paris (France).
It is expressly specified that the
does not include the annual cost of the customer's domain name, which remains at the customer's expense. The average cost of a domain name is €10 (excl. VAT) per year.
4. Rates & payment terms
- Set-up costs 490 (excl. VAT) invoiced on delivery of the site.
- Monthly packages (12-month firm commitment) :
- Standard: €79 excl. VAT/month (1 card update/month)
- Business: €99 excl. VAT/month (up to 10 tickets/month)
- Premium: €149 excl. tax/month (up to 20 tickets/month)
Monthly payments are due at the beginning of each month.
5. Delivery times
The delivery time is 4 weeks from receipt of all the necessary elements supplied by the customer. Any delay in the transmission of content extends the delivery time accordingly.
6. Maintenance and updates
Maintenance requests are made via a dedicated form accessible on a customer intranet. Each request constitutes a ticketThis is considered as a request to modify a plate, banner, novelty insert or stories.
Tickets are processed within a maximum of 72 working hours. The number of tickets is limited by the subscription package.
Any additional request (custom-made ticket) or overrun of the monthly quota may be subject to additional invoicing, on the basis of a quotation accepted by the customer.
7. Ownership and rights of use
The customer has a personal, non-exclusive and non-transferable right to use the site for the duration of the contract. Under no circumstances may the customer claim ownership of the site, its architecture or its source code.
Any attempt to reproduce or extract the design is strictly forbidden. Content supplied by the customer remains the full property of Polarized. Polarized reserves the right to use the site for communication or commercial reference purposes.
8. Arrears & termination
In the event of non-payment for more than 60 days, Polarized may suspend access to the website without prior notice.
Any early termination does not interrupt the initial commitment: the customer remains liable for payment of monthly instalments until the due date. The contract is renewed by tacit agreement, unless terminated by letter or e-mail one month before the anniversary date.
9. Third-party modules
Polarized cannot be held responsible for the operation or unavailability of third-party tools (Zenchef, Lafourchette, Google Maps, Instagram, etc.), which are the sole responsibility of their respective providers. Polarized does not configure or maintain these services.
10. Personal data & RGPD
When the site includes a contact form, the customer is responsible for processing the data collected.
Polarized uses the Matomo solution configured in compliance with the requirements of the General Data Protection Regulation (GDPR), with settings guaranteeing the anonymization of browsing data.
By default, reservation data is managed directly by the customer's third-party tools (Zenchef, Lafourchette, etc.).
11. Applicable law & jurisdiction
These terms and conditions are governed by French law. Any dispute relating to the interpretation or performance of the contract shall be subject to the exclusive jurisdiction of the French courts. Antibes commercial court.
